Age Discrimination

The Age Discrimination in Employment Act (ADEA) prohibits discrimination in the workplace based on age, addressing the growing impact of an aging workforce. Unlike other forms of discrimination, age discrimination often stems from false stereotypes linking age with ability. The ADEA aims to fulfill its congressional intent through a broad interpretation, allowing individuals to bring actions in state or federal court. However, it does not require employers to provide special treatment to older workers or legislate seniority rights, which are derived from contracts.
